Misery of Mind Dark clouds drew closer to Paddington square. Thick drops of rain broke as they hit the ground. A frozen sculpture of an eagle standing on the world, beneath the winter moon, stared at John with its little stony eyes. John felt an instant moment of remorse, standing, soaked, at the front door of his house. In his hand spools of suffering as the thunder roars. A moment of intense lightening. John shivered in the cold, as he dared not meet the eye of the eagle. He noticed a figure run in the distance out of the corner of his eye. John saw a figure get in a car and drive off. Standing scared of his own shadow, John lifted his left hand, agony in his wet pocket, as rain drips from the end of his nose, shattering on the welcome sign at the door. In his darkroom he was finally alone with the spools of suffering now set out in ordered rows. The only light was red, tenderly glowing as though he was in a church: John the priest preparing the mass. Solutions lie now in trays beneath his hands. Tension mounted in him as the photo processed. John waited anxiously, with a Mr Kipling cake in his right hand. His hands trembled. Features faintly started to twist before his eyes, a half formed ghost. John saw his life end in front of him. He found it hard to breath, as if his lungs were bare. The feeling of being alone was no longer their, John felt as though he was being squeezed around his neck. The cold crept into his body through the surface of his skin. The beat of his heart was fading. He saw only one shadow, his own, as he looked round the room tortured. Then his neck was let loose. Air was now his obsession as John gasped in relief. John looked again at the trays as twisting features slowly formed a figure of a person. Reluctantly he recognised this person. It is his Sarah. She lay before him on the floor, in the kitchen by the cupboard, pleading for her life as John held a razor-sharp knife, standing over her, his bear like shadow across her. She tries to fight back and strikes his left hand with her sharp red nails. He punches her fiercely, full force as tears of blood came down the face of Sarah. Malaysian Legal History Essay
The Straits Settlements were a group of British territories located in Southeast Asia. Originally established in 1826 as part of the territories controlled by the British East India Company, the Straits Settlements came under direct British control as a crown colony on 1 April 1867. The colony was dissolved in 1946 as part of the British reorganisation of its south-east Asian dependencies following the end of the Second World War. The Straits Settlements consisted of the four individual settlements of Malacca,Penang (also known as Prince of Wales Island), Singapore (with Christmas Island and the Cocos Islands). The island of Labuan, off the coast of Borneo, was also incorporated into the colony with effect from 1 January 1907, becoming a separate settlement within it in 1912. With the exception of Singapore, Christmas Island, and the Cocos Islands, these territories now form part of Malaysia. The Island of Penang in highligh was under the governance of Sultan of kedah however its noted that after the esthablishment of English East India company an agreement was penned by the Ruler of Kedah and the company for penang. Now in judging what is the ââ¬Å"ââ¬â¢lex lociâ⬠of the island will require answers to two questions as below: i) Was the Island a ââ¬Å"settledâ⬠or ââ¬Å"cededâ⬠colony?. ii)Was the law of Kedah to be applied to island of Penang on ground that the island was ââ¬Å"cededâ⬠? For the first 20 years after esthablishment , it was noted that the only law in place was ââ¬Å"Regulations of 1794â⬠or ââ¬Å"nature of lawâ⬠. On March 1807, the English Crown granted the first charter of justice, which resulted in the esthablishment of Court of Judicature in Penang. The effect of this charter could be seen in Kamoo v Basset, In re Goods of Abdullah and Reg v Willans. The Kamoo v basset (1808) case, notes that the plaintiff a native of Bengal, had agreed to be an employed by the defendent who was an army officer in the Bengal Native Infantary. However upon severe mistreatment by the employer an Police Majistrate complaint was made by the plaintiff. The plaintiff filed and action for assault,battery and false imprisonment against the defendent,claiming damages for $600. The verdict in short noted payment to plaintiff in $150 with cost. In the Goods of Abdullah (1835) is noted the principle issue is whether a Muslim,who died in Penang,device his entire property by means of will? However it was decided that the will of Abdullah being esthablished as a valid instrument. In the case of Fatimah Ors v Logan Ors it was noted that since 1786 , Penang being then a desert and uncultivated island,inhabited except by few intinerant fisherman and without any fixed institution was ceded by the Rajah of Kedah to Captain light,an office of EIC,for and on behalf of the company. This fact was important in this case in view of the platiffââ¬â¢s petition to obtain a decree of the court declaring that the deceased died intestate. Three preliminary question arised in this case which were, i) Wheter the capacity of the deceased to make a will is to be decided by Mohamedan or by English law. The verdict was given as the deceasedââ¬â¢s capacity to write a will will be decided by ââ¬Å"lex lociâ⬠and not by Mohamedans law. Other Important cases in aspect of the ââ¬Å"lex lociâ⬠includes Choa Choon Neoh v Spottiswodde, Isaac Penhas v Tan Soo Eng, Shaik Sahied v Sockalingam Chettiar. Reception of English Law in Malay States. As noted earlier common law and equity was applied in the straits settlements by virtue of the three charter of justice. The charters however did not apply to the Malay states. The introduction of the Resident system in Perak according to the Pangkor Treaty 1874, allowed the introduction of english styled courts by the Sultan and english judges were appointed. It should be noted that beggining with the civil Law Enactment No 3 of 1937,such judicial practise received the official stamp of approvalby legislature. Section 2 (i) of the enactment provides that ââ¬Å"save in so far as other provision has been or may hereafter be mada any written law in force in the federated Malay states,the common law of england,and the rules of equity,as administrated in england at the commencement of this Enactment shall be in force in the Federated Malay states. On case which can be disscussed in terms of ââ¬Å"common lawâ⬠are the Goverment of Perak v A.R Adams (1914) , which concerns damage to the plantiffââ¬â¢s land by the defendent. The question which was arised was wheter the defendant is exempt from liability on the ground that he was without wilfulness or negligence using his land on the principle that a man must use his own land and not to damnify another. The court found the defendent guilty under all circumstances he is liable for the damage caused. In re the will of Yap Kwan Seng, which the deceased gave direction in his will that his hose and land be held in trust for ever for a family house for ancestral worship and as family burial ground in accordance with chinese customs. The Issue before the court was whether such a custom was valid a not. The arguments made were (1) That the rule against perpetuities does not excist in and should not be adopted in the federated malay states, (2) That even if the rule be applied,the trust are saved from offence agaist it, (3) That having regard to chinese customs the trust should be regarded as religious and charitable and therefore without offence to the rule. During the proceeding of this case it was noted that the rule agaisnt perpetuities has never been applied in the states. However it was concluded that to regard these trust either as trust for religious purposes or as trust concerning or benefitting the community at large or any portion of it,it follow that there is no way to be sa ved or excepted from repugnancy to the rule of perpetuities and are therefore void. In the case of permodalan plantations sdn.bhd v Rachuta sdn.bhd (1985) can be discussed as legal set off which is based on english statute is not included in the expression ââ¬Å"the common law of englandâ⬠. Only equitable set ââ¬âoff is part of the local law and consequently the court can only deal with and equitable set-off.

Racist Commenters on Mark Zuckerbergs Marriage
Racist Commenters on Mark Zuckerberg's Marriage No one has a problem with interracial marriage anymore, right? Poll after poll shows that public support of these unions is at record highs. The 2010 census revealed not only that interracial marriages are up but also that mixed-race children are the fastest growing group of young people. These days television shows feature interracial couples in storylines where race never causes tension. Altogether that means that interracial marriage is simply a non-issue in post-racial America, doesnt it? Not quite. The online reaction to Facebook chief Mark Zuckerbergs wedding on Saturday to Priscilla Chan is a clear reminder that the country has a long way to go before interracial marriage becomes widely and genuinely accepted. The day after Zuckerbergs nuptials the comments sections of websites reporting the news included several hateful remarks criticizing the couples looks and taking aim at their wealth. Thats par for the course online, though. What really stood out is the series of comments with a decidedly racial bent. On the Los Angeles Times website, a commenter named Waskoman exclaimed, Man, those mail order compaines have some hot chicks!Ã Just kidding!!! Another, using the moniker Jihadlives, remarked, He married a chank? Ã Whats up with that? What we have here is the assumption that because Chan has Chinese ancestry she cant be an American. Of course not. She must be a woman Zuckerberg shipped from overseas to be his submissive bride. In reality Chan is far from a mail order mate. Shes an Ivy League-educated doctor who could hold her own without Zuckerberg, but the facts of the situation dont easily lend themselves to racist and sexist stereotypes. The second commenter relied on a misspelled racial slur rather than on a racial stereotype to object to Zuckerbergs decision to marry Chan. On a different note, a third L.A. Times commenter accused Zuckerberg of killing his own kind by intermarrying. Ome-Coatl wrote: Why didnt he marry a nice Jewish girl?I once read a conservative Jewish commentator say that Americas intermarriage culture is destroying Jews more effectively than did the Nazi gas chambers. Perhaps it was hyperbole... or was it? The L.A. Times website was hardly the only one where racist commenters took aim at Zuckerberg and Chan. A commenter named Morney on the gossip web site Gawker applauded Zuckerbergs decision to marry interracially but for completely inappropriate reasons. He wrote, Good for Mark to marry a submissive Asian woman, instead of a spoiled American. Shes not a looker, but this way shell take care of him and raise his kids, while he can still hit much hotter #$!* on the side. Once again, theres the assumption that Chan is not from the United States, as if Asian Americans dont exist. This commenter also assumes because Chan has Chinese heritage shell be content to serve as Zuckerbergs caretaker (instead of the doctor she studied to be) and will be so passive shell be cool if Zuckerberg cheats on her. On Gawker, a couple of commenters tried to show Morney that not all Asian women are passive, but they did so by invoking the Dragon Lady stereotype. Youve never dated an Asian woman have you? commenter Tsol asked Morney. Especially a driven achiever like Priscillathere is nothing submissive about them. In fact I guarantee that shes the one wearing the pants in that relationship. Theres a reason the Dragon Lady stereotype stills exists. A word to the wise: you dont fight a stereotype by mentioning another stereotype. Just as all Asian women arent submissive, all Asian women certainly arent domineering, so no one can guarantee that Priscilla Chan wears the pants in her relationship with Zuckerberg. As for why racial stereotypes still existits because racism still does. On TMZ.com commenters plainly suggested that Chans Asianness makes her a whore. Bet she love him long, long time, a commenter named Really? quipped. Others followed suit, and the scary thing is that a number of these comments received more favorable ratings from other viewers than unfavorable ones. So, who cares if racist commenters dont like the fact that Mark Zuckerberg married a Chinese-American doctor? He could buy and sell everyone of those haters. That may be true, but if people exhibit this level of racial animus concerning a powerful couple they dont even know, imagine how people regard the interracial couples they pass on the street, live next to or are related to? Its also important to note that interracial couples consisting of a white man and an Asian woman are largely regarded as the least threatening of all. Given this, if Zuckerberg and Chans marriage can stir up this much hate, what must interracial couples with a different ethnic makeup endure?

Huey Newton, Co-Founder of Black Panther Party Huey Newton was an African American political activist who co-founded the Black Panther Party in 1966. When Newton was convicted for the fatal shooting of a police officer, his imprisonment became a common cause among activists in the United States. The slogan Free Huey appeared on banners and buttons at protests across the country. He was later released after two re-trials resulted in hung juries. Early Life and Education Huey P. Newton was born in Monroe, Louisiana, on February 17, 1942. He was named after Huey P. Long, the former governor of Louisiana who became notorious as a radical populist in the early 1930s. In 1945, Newtons family moved to California, drawn by the job opportunities that arose in the Bay Area as a result of the wartime industrial boom. They struggled financially and moved around often throughout Newtons life. He completed high school- which he later described as an experience that nearly killed [his] urge to inquire- without being able to read (he later taught himself). After high school, he earned an A.A. degree from Merritt College and took law school classes at Oakland City College. Starting in his teen years and continuing through college, Newton was arrested for crimes like mostly petty crimes such as vandalism and burglary. In 1965, when he was 22 years old, Newton was arrested and convicted of assault with a deadly weapon and sentenced to six months in jail. Most of his sentence was served in solitary confinement. Founding the Black Panther Party During his time at Oakland City College, Newton joined the Afro-American Association, which inspired him to become politically and socially conscious. He later said that his Oakland public education had made him feel ashamed of being black, but that his shame began to transform into pride once he encountered black activists. He also began reading radical activist literature, including works by Che Guevara and Malcolm X. Newton soon realized that there were few organizations advocating for lower class African Americans in Oakland. In October 1966, he joined up with Bobby Seale to form a new group, which they called the Black Panther Party for Self Defense. The organization was focused on fighting police brutality in Oakland and San Francisco. With Seale as chairman and Newton as minister of defense, the Black Panthers quickly assembled a membership and began patrolling Oakland neighborhoods. When police were spotted interacting with black citizens, the Panthers would approach and inform the civilians of their constitutional rights. Newton took part in such actions, sometimes while brandishing a law book. The organization adopted a uniform of black leather jackets, black berets, and sunglasses. This distinct uniform, as well as their prominent display of guns and bandoliers of shotgun shells, made the Black Panthers highly noticeable. By the spring of 1967, stories about Newton and the Black Panthers began appearing in major publications. Guns and Political Power The Black Panthers encouraged black citizens of Oakland to begin carrying firearms, citing their Constitutional right under the Second Amendment, and tensions between police and the Black Panthers continued to grow. An article published in the New York Times on May 3, 1967 described an incident in which Newton, Seale, and about 30 other Black Panthers strode into the California capitol in Sacramento with their weapons prominently displayed. The story was headlined Armed Negroes Protest Gun Bill. The Black Panthers had arrived in dramatic fashion to voice their opposition to a proposed law against carrying firearms. It seemed the law had been drafted specifically to curtail their activities. Weeks later, in another article in the New York Times, Newton was described as being surrounded by armed followers in an apartment in San Franciscos Haight-Ashbury neighborhood. Newton was quoted as saying, Political power comes through the barrel of a gun. Arrest and Conviction About a year after the Black Panthers first rose to prominence, Newton became entangled in a high-profile legal case. The case centered around the death of John Frey, who died after pulling over Huey Newton and a friend for a traffic stop. Newton was arrested at the scene. In September 1968, he was convicted of voluntary manslaughter and received a sentence of two to 15 years in prison. Newtons incarceration became a major cause among young radicals and activists. Free Huey buttons and banners could be seen at protests and anti-war rallies nationwide, and rallies for Newtons release were held in numerous American cities. At the time, police actions against Black Panthers in other cities made headlines. In May 1970, Newton was granted a new trial. After two trials were held and both resulted in hung juries, the case was dropped and Newton was released. The specific events, as well as Newtons potential culpability, surrounding John Freys death remain uncertain. Later Life Following his release from prison in 1970, Newton resumed leadership of the Black Panthers and began studying at the University of California at Santa Cruz, where he earned a B.A. in 1974. After a period of relative quiet, Newton was charged with the murder of a teenage sex worker named Kathleen Smith. He was also arrested for assaulting his tailor. Newton fled to Cuba, where he lived in exile for three years. In 1977, Newton returned to California, asserting that the political climate in the United States had changed enough that he could receive a fair trial. After juries were deadlocked, Newton was acquitted of the murder of Kathleen Smith. He returned to the Black Panther organization, and also returned to college. In 1980, he received a Ph.D. from the University of California at Santa Cruz. He wrote a thesis about the repression of the Black Panthers. Death and Legacy In the 1980s, Newton grappled with drug addiction and alcohol abuse. He remained involved with neighborhood programs pioneered by the Black Panthers. However, in 1985, he was arrested for embezzling funds. He was later arrested on a weapons charge, and was also suspected of being involved in the drug trade. In the early hours of August 23, 1989, Newton was shot and killed on a street in Oakland, California. His killing was reported on the front page of the New York Times. Tyrone Robinson confessed to the murder, and it was concluded that the killing was connected to Newtons significant debt caused by his cocaine addiction. The purpose of this report is to review and convey the basic theoretical and implementation knowledge of web development through suggesting two enhancements to the existing setup of Fries Deli. The report presents an online static informational system for the Fries Deli and a dynamic feedback system for publishing user feedback regarding the various Fries Deli food services. It implicitly highlights how the technologies are picked from the available choices in view to the requirements of these two websites. 2. Theoretical Research and Evaluation Websites comprise of information coded i n a form which can easily travel over the internet. The informational needs of a person or company keep varying [1]. In accordance to these ever changing requirements, websites are of different types. Websites could be informational (static pages where content remains the same) [2], data-driven (dynamic pages where the updated data is displayed) [3], interactive (where some type of input is required from the user), closed access (private i.e. accessible only to authorized users), open websites (accessible to public) and website with frequently updated content. In order to handle this wide variety of websites, there are different methods of creating them. In the earlier ages of web development, the developers used to build websites from scratch. With the increase in web complexity [4] and advancement of web technology, web tools and editors [5] were developed that either assisted with the coding process, or made the web designing process entirely visual or both. And finally the conte nt management systems were introduced [6]. Whatever method was chosen, the websites created are required to be usable and accessible [7, 8]. The objective of the website is to share and access information. The website should be designed such that it is easy to use and learn them [9]. They must allow for both the abled and disabled users to be able to retrieve information. In order to access websites, they need to be assigned a domain name and be hosted onto some server wherefrom they can be accessed. The browser is a client application the runs on the userââ¬â¢s computer. It takes the request from user, transmits them onto the network and displays the serverââ¬â¢s response to the request. Thus there are two areas where data can be manipulated; the client side and the server side. There are web standards that require to be followed by the websites created [10, 11]. XHTML, HTML is the standardized markup language used for presenting the content of a website i.e. the headings, co ntents, links, images, forms, etc. CSS is the standardized styling language used for defining the visual style of the website interface i.e. the colour of headings, text, links, etc. JavaScript, AJAX, JQuery, Flash are some of the language for programing the client side scripts.
